These Terms of Use ("Terms") apply to your use of Apna Showcase ("Platform"). In these Terms, "we", "us" and "our" refer to Apna Showcase.
A person or business using the Platform to create or publish a catalogue is referred to as the "Business Owner".
A person who views a catalogue or contacts a Business Owner about its products or services is referred to as an "End Customer".
By using the Platform or providing information to us for creating or maintaining a catalogue, the Business Owner agrees to these Terms.
1. Our Service
The Platform provides technology that helps Business Owners create and publish product catalogues online and allows End Customers to contact or enquire with the Business Owner through available communication channels, including WhatsApp.
The Platform Owner provides the technology and catalogue service only. The Platform Owner does not sell, manufacture, supply or deliver the products or services shown in a catalogue.
2. Business Owner's Responsibility
The Business Owner is responsible for the information and content provided for their catalogue, including:
- business and contact information;
- product names, descriptions, images and specifications;
- prices, offers and availability;
- claims or other information about products or services; and
- compliance with laws applicable to their business and products.
The Business Owner should ensure that catalogue information is accurate and kept reasonably up to date.
3. Brands, Intellectual Property and Product Authenticity
The Business Owner is responsible for ensuring that the products and content listed in their catalogue are genuine and legally offered for sale.
The Business Owner must not use the Platform to knowingly list, advertise or sell:
- counterfeit, fake or unauthorised duplicate products;
- products that misuse another person's brand, trademark or logo;
- copied or pirated images, product descriptions, designs or other material;
- products or content that infringe another person's intellectual property or other legal rights; or
- products that the Business Owner is not legally permitted to sell.
The Business Owner must have the necessary rights, licences or permissions to use any brand name, trademark, logo, image, product description or other third-party material included in their catalogue.
If a brand owner, rights holder, authority or other legitimate party raises a complaint regarding a catalogue or its products, the Business Owner is responsible for addressing the matter and providing any reasonable clarification or supporting information requested.
The Platform Owner may remove, disable or restrict the relevant catalogue or content if there is a complaint, suspected infringement, counterfeit-product concern, or other reasonable indication of a problem.
The Business Owner is responsible for any claims, losses, penalties, costs or other consequences arising from counterfeit products, unauthorised products, brand infringement, intellectual-property infringement or other unlawful content supplied by the Business Owner, to the extent permitted by applicable law.
4. Catalogue Content
The Business Owner gives the Platform Owner permission to use, store, display and process the text, images, logos, trademarks and other material provided by the Business Owner as reasonably required to provide and operate the catalogue service.
The Platform Owner may make reasonable formatting, technical or display changes to catalogue content where needed for the Platform.
5. Products and Customer Transactions
The Platform is not a party to any transaction between a Business Owner and an End Customer.
Any enquiry, quotation, order, payment, delivery, return, refund, warranty or other arrangement is between the Business Owner and the End Customer.
The Business Owner is responsible for handling such matters directly with the End Customer.
End Customers should confirm product details, pricing, availability and other terms directly with the relevant Business Owner.
6. Use of the Platform
The Platform should not be used for unlawful, fraudulent, misleading or harmful activities, or to upload content that knowingly infringes another person's rights.
The Platform must not be used to interfere with the Platform, attempt unauthorized access, distribute malware, or affect another Business Owner's catalogue.
7. Changes, Removal and Suspension
We may remove, hide or restrict catalogue content, or suspend a catalogue or Platform access, where reasonably necessary for legal, security, technical, operational or other legitimate reasons.
This may include situations involving suspected counterfeit products, brand or intellectual-property complaints, unlawful content, misuse of the Platform, or violation of these Terms.
We may also make changes to the Platform, its features or catalogue format from time to time.
8. Responsibility for Business Owner Activities
The Business Owner is responsible for claims or problems arising from their catalogue content, products or services, or their dealings with End Customers, where these are caused by the Business Owner.
This includes issues relating to product authenticity, counterfeit or duplicate products, brand or trademark use, intellectual-property rights, product claims and applicable legal requirements.
The Business Owner agrees to reasonably cooperate with the Platform Owner if any such issue affects the Platform or the Platform Owner.
9. Our Liability
The Platform Owner provides the Platform on an "as available" basis and does not guarantee particular sales, enquiries, customer traffic or business results.
To the extent permitted by applicable law, the Platform Owner will not be responsible for indirect or consequential losses, loss of profits, business, revenue, goodwill or similar losses arising from use of the Platform.
Nothing in these Terms limits any liability that cannot legally be limited under applicable law.
10. Ending Use of the Platform
A Business Owner may stop using the Platform at any time.
The Platform Owner may suspend or discontinue a catalogue or the Platform, in whole or in part, where reasonably necessary, including for legal, security, technical or operational reasons.
11. Changes to These Terms
We may update these Terms from time to time as the Platform develops or when reasonably required.
The latest version will be made available on the Platform.
12. Governing Law
These Terms are governed by the laws of India.
Subject to applicable law, courts at Delhi, India will have jurisdiction.
